Culto Futbol Privacy Notice

Innovasport USA (ECOM), LLC (“Culto Futbol,” “we,” or “us”) provides this notice (“Privacy Notice”) to inform you of our personal information handling practices for personal information we collect from those who contact us and visitors to us.cultofutbol.com and other web and mobile sites operated by us that link to this Privacy Notice (collectively, the “sites”). This Privacy Notice describes how Culto Futbol processes the personal information that you provide to us or we collect from you through our sites, and does not cover any personal information we collect offline.

2. INFORMATION WE COLLECT ABOUT YOU

We collect and process the following personal information about you:

i. Information you give to us directly.

We collect information about you when you: create an account on our sites; place an order and purchase products from our sites; fill in forms on or interact with our sites; correspond with us (e.g., when you contact Culto Futbol’s customer service team); request information about our services; and report a problem with our sites.

The information you give us may include your name, alias, username, date of birth, phone number, email address, billing address, shipping address, payment information (including credit card number, expiration date, verification code, and/or information for alternate payment types), and other information that you choose to provide. If you create an account with us, we collect account information including your username, password, security questions, preferences and settings. Providing such personal information is voluntary. However, without providing such personal information, we may not be able to provide you with information or services you request from us. You will know what personal information you provide because you will actively submit it to us.

ii. Information we automatically collect about you.

In addition to the personal information that you actively provide, the sites may automatically collect, process, and store certain information about you:

  • Technical information, including the type and version of your web browser, network connection, device identifier, operating system and platform, IP address, and location and time zone setting.
  • Information about your site visit, including the pages or products viewed on our sites, the items you put in your cart, add to your wishlist, or purchase, return, exchange or cancel and your past transactions, the search terms used on our sites or to locate our sites from external search engines, your interactions with the sites (including how and when you interact with or navigate the sites), and website performance during your visit.
  • Information collected through cookies, pixel tags, and other similar technologies. Please review Section 3 below for more information.

3. COOKIES

When you use our sites, we, our service providers, and third parties (such as advertising networks, analytics providers, and social media networks) we work with, collect personal information about you through cookies and similar tracking technologies. You can control and adjust your cookie and tracking technology preference settings as further detailed below in this section.

Cookies and Pixels

A cookie is a small text file saved on your device or browser when you visit a website, open or click on an email, or interact with an advertisement. Some cookies are necessary for the functioning of our sites, and these are known and strictly necessary cookies. Other cookies are not required for full functionality of our sites, and these are known as non-essential cookies. Some cookies are persistent cookies which remain on your device until you delete them, and other cookies are session cookies which are automatically deleted when you exit your internet browser. We incorporate both first party cookies (which are cookies served directly by us) and third-party cookies (which are cookies served by third parties we work with).

Pixels (also known as web beacons) are code embedded within a service. We use cookies and pixels for a variety of purposes, including to:

  • Provide us with analytics about our sites, including by counting visits and traffic;

Our cookie preference center allows you to control your cookie settings on our websites, except for strictly necessary cookies, which cannot be adjusted, as they are necessary to access and use our sites. Your cookie preference settings apply on a per site and per browser basis. So, if you use multiple browsers or visit multiple sites, you will need to manage your preferences for each browser and manage your cookie preference settings for each site. If you reset or clear cookies on your device, you will undo the preferences you previously elected on each of our sites. To re-elect these preferences, you will need to revisit the cookie preference center on each site. If you block cookies, certain features on our sites may not function. If you reject all cookies and tracking technologies, you will not receive any targeted advertisements based on your browsing activities and interests, but you may continue to receive general advertisements for our products based on other interactions you have with our sites.

4. HOW WE USE YOUR INFORMATION

To the extent permitted under applicable law, we will use personal information held about you for the purposes described below:

  • Establish and verify your identity and the accuracy of your information.
  • Manage user relationship and communicate with you, including to respond to your inquiries and fulfill your requests.
  • Provide you with the information, products, and services you request from us and carry out our obligations arising from any contracts entered into between you and us, including to process, maintain, and service your accounts, process your payment information, ship and fulfill your order, provide you with invoices and/or confirmations, provide customer support, and enable service providers to perform the services on our behalf or assist us with our provision of services to you.
  • Measure and understand the effectiveness of the advertising we serve to you and others and deliver relevant advertising to you.
  • Provide you with more interesting and customized information, promotions, and advertising.
  • To the extent permitted by applicable laws, provide you, or allow selected third parties to provide you, with information about goods or services we feel may interest you. You may opt out of receiving marketing communications from us or our affiliates by unsubscribing through the unsubscribe or opt-out link in the email sent to you.
  • Administer, facilitate, and improve operations of our sites, including for troubleshooting, data analysis, testing, research, statistical and survey purposes.
  • Ensure that content from our sites is presented in the most effective manner for you and your device.
  • Send you administrative information, including information about our sites and changes to our services, terms, conditions, or policies.
  • Handle and record consumer rights requests, including opt-ins and opt-outs.
  • Monitor and enhance the safety and security of our sites, including to prevent fraud or other unauthorized or illegal activity.
  • Conduct internal audits and investigations.
  • Comply with laws and regulatory requirements, enforce our terms and conditions, respond to lawful requests, court orders, and legal processes, and protect and defend the rights, property, or safety of us, our affiliates, employees, customers, users, and others.

5. DISCLOSURE OF YOUR INFORMATION

To the extent permitted under applicable law, we may share your personal information with:

i. Any member of our group: For example, we may share your personal information with Culto Futbol’s group companies to provide you with products and services, provide you with customer support, process your payments, understand your preferences, offer targeted advertising, send you information about products and services that may be of interest to you, and conduct other activities described in this Privacy Notice.

ii. Select service providers and third parties including:

  • Service providers who act as our data processors. These service providers perform services on our behalf and assist us with the provision of our sites and services. For example, they may assist us with powering our sites, payment processing, processing and fulfilling orders placed by customers, fraud prevention, marketing, purchase financing, and customer support services.
  • Analytics and search engine providers that assist us in the improvement and optimization of our sites.
  • Business partners that enhance our advertising efforts.

iii. Other third parties in the following circumstances:

  • If we sell or buy any business or assets, in which case we will disclose your personal information to the prospective seller or buyer of such business or assets.
  • If we or our affiliates, or substantially all of the assets of any of the foregoing, is acquired by a third party, in which case personal information held by it will be one of the transferred assets.
  • To comply with any legal obligation or request from law enforcement, enforce or apply our agreements, or to protect the rights, property, or safety of us or our affiliates, employees, customers, users, or others.

6. INTERNATIONAL DATA TRANSFERS

Your personal information may be disclosed to employees, representatives, or other third parties including our service providers operating outside of the country you are based, or who are engaged by us or our affiliates in other countries, including the United States and in other countries where we operate. These persons and third parties may also store, transfer, or access personal information outside of the country you are based. In disclosing your personal information overseas, we will take such steps as are reasonable in the circumstances to require that overseas recipients protect your personal information in accordance with applicable laws.

7. YOUR RIGHTS AND CHOICES

If you reside in certain states, including Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah or Virginia, you may have, or may soon have, the following rights under the privacy laws of your state, subject to the conditions under applicable laws:

  • To confirm whether or not we process your personal data and obtain copies of such data (in some cases, in a portable manner);
  • To correct inaccuracies in the personal data we hold about you, taking into account the nature of the personal data and the purposes for which it is processed, except this right is not available in Iowa and Utah;
  • To delete personal data that we hold about you;
  • To opt out of our processing of your personal data for the purposes of targeted advertising. To provide you with more interesting and customized information, promotions, and advertising, we disclose personal information to third-party providers of advertising services who may use such personal information for their own purposes or to serve other customers, including to display our advertisements to you on sites and services that we do not operate.   • To opt out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. We do not engage in such profiling;

You may submit a request to exercise your rights by following the instructions provided above or by contacting us using the contact information provided in Section 10, Contact Us. We will respond to your requests to exercise your privacy rights in accordance with applicable law. We may request additional information from you to verify your identity and complete your request. If we decline to take action on a request exercising one of your rights set forth above, you may have the right to appeal our decision. In these cases, we will notify you providing our reasons for denying the request and instructions for how you can appeal the decision.

8. RELATIONSHIP WITH SHOPIFY

The sites are hosted by Shopify, which collects and processes personal information about your access to and use of the sites in order to provide and improve the sites for you. Information you submit to the sites will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the sites for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our sites, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. 9. CHANGES TO OUR PRIVACY NOTICE

We may change this Privacy Notice from time to time. If we make changes, we will notify you by revising the date at the top of this Privacy Notice. If we make material changes, we will provide you with additional notice (such as by adding a statement to our sites or sending you a notification).
